Has your credit union implemented the proper procedures for handling subpoenas, garnishments, levies, and other demands for member funds? Most credit unions deal with these matters daily, but many do so without proper training. Handling these matters improperly can expose your credit union to significant liability. This seminar will explain these complicated legal documents – subpoenas, garnishments, levies, summons, attachments, etc. – and the situations when they are served on the credit union. He serves on the Board of Directors of Public Private Businesses Inc., (PPBI) a non-profit dedicated to improving cooperation and understanding between public and private sector emergency managers. The Department of Labor (DOL) issued an interpretive ruling on March 24, 2010, which holds that employees who perform the typical job duties of a mortgage loan officer do not qualify as bona fide administrative employees that are exempt under the Fair Labor Standards Act (FLSA). Thus, most mortgage loan officers are considered non-exempt employees and are entitled to overtime pay.

Although the recent DOL ruling specifically addressed mortgage loan officers, its analysis is applicable to all types of employees. Financial institutions must ensure that all employees receive at least the applicable minimum wage for all hours worked. Consequently, credit unions must analyze each employee’s duties and responsibilities to determine whether they are within the administrative employee exemption or an alternative FLSA exemption. This webinar will cover this recent ruling and explain the analysis your credit union must use to determine whether an employee is exempt from overtime pay.

The Interagency Fair Lending Examination Procedures were revised in late 2009. This update reflects the changing environment and is, in part, a direct result of the recent regulatory focus on subprime lending. Several clarifications were made regarding pricing, steering, redlining, broker activity, performing examinations with small sample sizes, and data accuracy. As a result of these changes, credit unions should be asking themselves some key questions:

* Does my credit union’s internal or external fair lending review function meet current expectations?
* Will my credit union be prepared for its next fair lending examination?

The Federal Agencies have published final rules implementing the Secure and Fair Enforcement for Mortgage Licensing Act (SAFE Act). The Act mandates that all mortgage loan originators employed by regulated institutions formally register with the National Mortgage Licensing System and Registry (NMLSR).
